BUYER IDENTIFICATION

SCOPE
These general conditions of sale, service and payment are applicable to all contracts concluded in Belgium between SPRL FISSETTE and third parties within the framework of its internet sales site exclusively.
They only apply when it concerns a distance sales contract within the meaning of article 2.21° of the law relating to market practices and consumer protection of 04.06.2010.
SPRL FISSETTE reserves the right to modify its general conditions at any time.
However, current contracts remain subject to the conditions applicable at the time the sale is concluded. -
DEFINITION
The non-professional buyer or consumer is defined as any natural or legal person who acquires or uses for purposes excluding any professional nature of the services or products presented by SPRL FISSETTE.
The professional buyer is defined as any person not falling within the definition given above, that is to say as any natural or legal person who acquires or uses for partially or totally professional purposes the products or services presented by SPRL FISSETTE, its accounting and tax declarations being authentic against it.
The professional buyer cannot take advantage of the specific legal protection which is established for the benefit of the consumer by the law relating to market practices and consumer protection. -
FORMATION OF THE CONTRACT
The product catalog and their description appearing on the FISSETTE SPRL website do not constitute an offer as such.
It is therefore not enough to go through the order procedure on the site for the formation of the contract.
SPRL FISSETTE will send an order confirmation including in particular the price of the goods or services ordered including the related taxes as well as the price of possible transport of the goods and the total amount which will be paid by the buyer as well as the place and the delivery time.
The contract is supposed to be formed on the day of sending against acknowledgment of receipt of the confirmation email to the buyer.
The contract is therefore deemed to be concluded at the headquarters of SPRL FISSETTE.
Confirmation of the order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and waiver of the right to rely on one's own conditions of purchase or other conditions.
SPRL FISSETTE also reserves the right to ask the buyer for additional information and to refuse execution of the order in the absence of an adequate response.
The products and services offered are those which appear in the catalog published on the FISSETTE SPRL website.
These products are offered while stocks last.
Each product offered on our site is the subject of a description established by the supplier. -
RIGHT TO RETRACT
For orders placed on the fissette.com website, the online customer has a 14-day right of withdrawal.
The items will be returned to the store address listed on the contact page of the site.
Postage costs remain the responsibility of the customer.
Returns with freight collect or cash on delivery will be refused.
If your items have any defects, the postage costs will be refunded.
In the event of abnormal or abusive returns, Fissette.com reserves the right to refuse a subsequent order.
A copy of your purchase invoice with your contact details as well as your bank account (IBAN and SWIFT) must be attached to your shipment so that we can make the reimbursement within 30 days of receipt of the shipment.
For all complaints, proof of submission of your item to a post office or carrier will be required as well as acknowledgment of receipt.
This right of withdrawal is not applicable in particular:
> For the purchase of perishable goods, such as foodstuffs, chemicals.
> For the purchase of audio or video recordings and computer software when they have been unsealed by the Internet user.
> For consumables or maintenance products that have been opened.
> For spare parts and components.
> For the tools used.
> For any item that has been ordered specifically at the request of a customer.
> Custom-made items (assembly, cable soldering, etc.)
> Items damaged by the buyer.
> Items whose packaging is not original, incomplete or whose instructions for use, assembly plan and/or parts or accessories are missing.
> Items damaged by negligence, misuse or repaired by third parties or by yourself.
Items returned in this condition remain available to the buyer at the store address listed on the contact page of the site and will not be refunded. -
TRANSFER OF OWNERSHIP
By way of derogation from article 1583 of the Civil Code, the goods sold, delivered or installed remain the exclusive property of SPRL FISSETTE until full payment of its invoices.
Notwithstanding this retention of title, all risks of loss and damage relating to the property concerned are transferred to the customer upon taking possession. -
PRICE
Prices are indicated in euros, all taxes included, excluding shipping costs.
Normal delivery and shipping costs are displayed taking into account the information provided by the customer relating to the place of delivery.
SPRL FISSETTE reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time of conclusion of the contract.
SPRL FISSETTE cannot be held responsible for any errors occurring in its offers.
However, a price may be incorrect. In this case we reserve the right to cancel the order.
Where applicable, we will charge the product price if it is lower than the stated price.
If the price is lower than our purchase price, we will cancel the order. -
PAYMENT
Payment for online orders can be made in several ways:
> with credit card
> using E-BANKING
> by transfer or traditional payment into our account
In the latter case, the delivery time will not take effect and the goods will only be shipped on the date of receipt of payment.
Payments made on the FISSETTE SPRL website are subject to a security system.
SPRL FISSETTE has adopted the encryption process to protect as effectively as possible all sensitive data linked to means of payment.
The buyer must specify in his order where he wishes the goods to be delivered.
He can either have it delivered to an address of his choice in Belgium, excluding a post office box, or have it delivered to the headquarters of SPRL FISSETTE, En Féronstrée, 100 in 4000 Liège.
In the event that he chooses to have this order delivered to the store, no transport costs will be charged to him.
If, on the other hand, he chooses to have it delivered to an address that he designates, he will have to assume the transport costs as these will be specified to him in the order confirmation according to the price appearing on the SPRL FISSETTE website.
In the event of absence or manifestly unfounded refusal by the customer when the delivery truck passes at the time agreed with the buyer, the costs incurred by the additional trip will be invoiced in addition.
SPRL FISSETTE undertakes to deliver the goods within the time specified in the order confirmation.
It undertakes to notify the buyer of a possible delivery delay beyond their control.
If this exceeds by 30 days that initially indicated by SPRL FISSETTE, the buyer may renounce the sale without compensation for any of the parties.
He must notify SPRL FISSETTE by e-mail, fax or registered letter within two days of the warning thus given by SPRL FISSETTE. -
DELIVERY
Delivery is made to the address indicated by the customer at the time of their order.
Depending on the weight, it will be carried out by Taxipost Secur (< 6 kg) or by a carrier (>6 kg).
If the customer is absent upon delivery:
> Taxipost Secur:
A notice of passage will be left and a 2nd free presentation will be made at the customer's request
> Carrier:
A delivery notice will be left and the goods will be made available for collection at Fissette during opening hours, Féronstrée 100 – 4000 Liège.
Following a new request by email from the customer and payment of shipping costs, a 2nd presentation will be made to the address indicated. -
OBLIGATION OF RECEIPT AND DEADLINE FOR COMPLAINTS
The professional buyer will have the obligation to receive the goods, to examine them, to see whether or not they correspond to the order they made from the day of delivery.
The non-professional buyer will have the obligation to carry out this receipt the day after the expiration of the 14-day period specified under the heading "withdrawal".
Complaints about items delivered or services rendered must reach SPRL FISSETTE at the latest within 15 calendar days from the date of delivery for the professional buyer, 15 calendar days from the day after expiration of the 14-day period referred to in the article "withdrawal for non-professional buyers".
Complaints must only be sent by registered letter to SPRL FISSETTE, En Feronstrée, 100 in 4000 Liège, and must be accompanied by a copy of the invoice and delivery slip.
After this period, the goods and services will be presumed to have been definitively approved as compliant by the customer, apparent defects being irrefutably presumed to be non-existent. -
GUARANTEE
SPRL FISSETTE guarantees the goods it sells and the services it provides in accordance with the law relating to consumer protection of September 1, 2004 published in the Belgian Official Gazette on September 21, 2004 and available on the website of the Federal Public Service Justice.
The two-year legal warranty applies.
This guarantee only covers defects in conformity existing at the time of delivery of the goods and are therefore excluded:
> any direct or indirect damage caused after delivery of the device as well as its contents
> elements or accessories whose regular renewal is necessary
> damage resulting from fire, water damage, lightning, accident, natural disaster
> defects caused expressly or by negligence, by injudicious treatment, poor maintenance or abnormal use or use not in accordance with the manufacturer's instructions
> damage resulting from commercial, professional or collective use.
The lack of conformity must be reported within two months after its discovery.
Any request for intervention must be addressed to SPRL FISSETTE, En Féronstrée, 100 in 4000 Liège.
When the customer calls directly on the manufacturer within the framework of the guarantee, the related costs are his responsibility.
In the event of intervention by a third party not designated by SPRL FISSETTE, the benefit of the guarantee is canceled.
The invoice or delivery note serves as warranty documents and must be kept by the customer and produced in original.
The duration of the warranty takes effect on the date of collection or delivery.
The warranty is not transferable.
It therefore does not apply in the event that the device changes ownership.
These conditions and restrictions do not affect the legal provisions referred to above. -
RESPECT FOR INTELLECTUAL PROPERTY
All intellectual property rights on the products made available to buyers by SPRL FISSETTE rest with it or with the suppliers who have authorized it to put the products on sale.
Under no circumstances may the buyer copy a product made available to him, nor reproduce it, translate it, adapt it, disassemble it, decompile it, imitate it, modify it, analyze it or reconstitute it without the agreement expressly or in writing from SPRL FISSETTE.
He will not be able to make any modifications to the software sold to him. -
PROTECTION OF PRIVATE LIFE
Your data is recorded in our file to keep you informed of our activities.
You can request to view, modify or even delete your data at any time.
Your data will never be passed on to third parties.
As soon as the user decides to acquire goods or services via the system, he is thereby required to reveal his identity, his e-mail address, his postal address as well as any other personal information necessary for the purpose. fulfillment of the contract.
As soon as the information is collected, SPRL FISSETTE uses it to manage orders.
At the same time, the user also authorizes it to use this data to establish statistics in order to improve its site, the goods and the service it offers.
This information may also be used to enable the dissemination, by any means of communication, of information relating to the commercial activities of SPRL FISSETTE and its customers.
FISSETTE SPRL will also retain personal data to facilitate subsequent orders.
At any time, the user thus listed may request to consult information stored on this subject and, where applicable, to rectify it if it is inaccurate by sending his or her request directly to SPRL FISSETTE, En Féronstrée, 100 at 4000 Liège. -
EVIDENCE
The parties accept electronic means of proof (e-mail, etc.).
For any information, complaint or question, the buyer can contact the FISSETTE SPRL store during opening hours or by email at fi7@fissette.com. -
APPLICABLE LEGISLATION OF COMPETENT COURTS
For any dispute, only Belgian law is applicable.
Commercial law is also applicable to professional buyers.
The courts of the district of Liège have sole jurisdiction to resolve disputes between the parties.
